Privacy Policy

Any time you place an order, sign up for our newsletter, submit your contact information and résumé for employment purposes, enter a contest, complete a ballot, or introduce or post any text, image, video, audio, or any information, content, or other materials through the Site or any other Company website—including any of the Company’s social networking websites and web pages such as Facebook, Instagram, Twitter, or YouTube—or otherwise provide personal information to the Company (including via mail, SMS, or email in regular correspondence), it is collected, used, and disclosed by the Company for various purposes as described herein.

Moreover, every time you visit the Site, the following information is automatically obtained and compiled: your Internet Protocol (IP) address and the domain name registry information associated with that IP address; identification of your internet browser, operating system, and hardware platform; the date and time of your visit; the name and address (URL) of the web page you viewed immediately prior to accessing the Site; your entire query (if any) that was entered into a search engine which led you to the Site; and any other “clickstream” data. This information is stored in our log files.

Occasionally, if your browser is not configured to prevent disclosure of such information, the following information may also be revealed: your name, email address, home and work addresses, telephone and fax numbers, and any plain text commentary.

Additionally, the complete record of your actions on the Site—including all pages visited, the time spent on each page, the information sent or received, and the names of all files uploaded or downloaded—is collected. This tracking information may be compiled by us in the aggregate and made available to third parties primarily to identify demographic data regarding our customers.

As previously stipulated, we also collect personal information from you when you provide it to us, such as when placing an order, signing up for our newsletter, submitting your contact information and résumé for employment purposes, completing an entry form to participate in a contest, ballot, promotion, or survey—whether online or at one of our retail stores—communicating with us by telephone, SMS, email, in-store, or otherwise, setting up a user account and password, logging in as a registered user of the Site and providing information in your account(s), or posting any text, image, video, audio, or other content through any of the Company’s social networking websites and web pages, such as Facebook, Twitter, Instagram, or YouTube.

As a result of these actions, you might provide us with personal information such as your name, date of birth, email address, postal addresses, telephone number(s), credit card information, product interest information, and financial information, and in certain circumstances, your comments, suggestions, ideas, opinions, and individual preferences. We may also maintain a record of your product interests and acquire information about you from other present and future Company Affiliates.

In light of the importance of protecting children’s privacy, we do not intend the Site for child audiences and do not collect, process, or use on the Site any information relating to an individual whom we know to be under 13 years old without the prior, verifiable consent of their parent or other legal representative. If a parent or guardian discovers that their child has provided us with personally identifiable information, that parent or guardian has the right, upon request, to view the information provided by the child and/or to require that it be deleted from our records. In such a case, we ask that the parent or guardian contact us using the details provided in the “Contacting Us” section below.

In order to better serve you, we may combine information you provide to us online, in our stores, by telephone, by SMS, or in writing regarding your product interests. We may also combine this with readily available demographic information to enable us to communicate with you—by telephone (including through automated dialing systems), SMS, email, mail, or otherwise—about our products, services, surveys, promotions, special offers, and contests. We also collect this information in order to:

1. Process your order and respond to inquiries regarding the status of your order;
2. Send you products that you have ordered or that have been ordered on your behalf, or send your friends, relatives, and associates products you have ordered on their behalf;
3. Maintain contact with you and provide ongoing personalized service; help us better understand and respond to your needs and preferences; develop customer profiles based on that information; and communicate special offers and promotions from the Company concerning our products and services;
4. Communicate special offers and promotions from the Company directly to you, on behalf of itself and/or third parties with whom the Company has entered into advertising and promotional agreements or other arrangements;
5. Enable you to participate in our promotions and contests, as well as those of third parties with whom the Company has entered into advertising and promotional agreements or other arrangements;
6. Develop, improve, market, and provide our products and services, and manage our business;
7. Compile information related to loyalty and earned rewards programs which we may establish from time to time, and to which you may be entitled based on your online and/or in-store product purchases; and
8. Help us meet applicable legal and regulatory requirements.

For example, we may use your personal information to complete merchandise purchases and returns. We may also use personal information to contact a purchaser when necessary, such as in the event of a delayed delivery or an out-of-stock item. In addition, the Company uses personal information to notify its customers about products, services, promotions, and special offers that may be of interest. We may also request additional information, such as annual income, buying preferences, or age—commonly referred to as demographic and profile data—although this information is optional and never required for placing an order or making a purchase. If you choose to provide such information, we may use it to improve our Site and enhance your shopping experience. We also use information collected from the Site to measure interest in various sections, to ensure that links facilitate easy navigation, and to help make the Site more interesting and informative.

Except as described in the Policy, any personal information disclosed to third parties is provided in aggregate, on a non-personally identifiable basis, and used primarily to identify demographic data regarding our customers.

• In the event of a sale of all or substantially all of our business, or another similar transaction (such as the sale of a division or business unit), we may transfer or disclose your personal information to a purchaser or prospective purchaser, who may collect, use, and disclose such information for the purposes of evaluating and/or effecting a proposed transaction, operating and managing the affairs of the acquired business, or for other purposes identified in this Policy.

• We may transfer personal information that we collect or that you provide, as described in this Policy, to contractors, service providers, and other third parties we use to support our business (such as analytics and search engine providers that assist us with website improvement and optimization), and who are contractually obligated to keep personal information confidential, use it only for the purposes for which we disclose it to them, and process the personal information according to the same standards set out in this Policy. Please note: we may process, store, and transfer your personal information in and to a foreign jurisdiction or country, where privacy laws may differ and may not be as comprehensive as Canadian law. In such cases, the governments, courts, law enforcement, or regulatory agencies of that country may obtain access to your personal information through the laws of the foreign jurisdiction. Whenever we engage a service provider, we require that its privacy and security standards adhere to this Policy and applicable Canadian privacy legislation.

• We reserve the right to disclose your personal information as required by law, in response to legal or regulatory processes and law enforcement requests by government authorities that have asserted a lawful right to access such information, to our legal counsel, or as necessary to protect the property, interests, and rights of the Company and any Company Affiliates.

You acknowledge and agree that the Company shall also have the right to incorporate, use, and reproduce any text, image, video, audio, or any information, content, or other materials you provide through the Site, by SMS, email, or post, through the Company’s social networking websites and web pages such as Facebook, Twitter, or YouTube, in whole or in part, in connection with the marketing and promotion of the Company’s business. You always have the right to revoke such consent in the manner described in the section “How do I exercise my choices about the collection, use and disclosure of my personal information?” below.

If you submit your contact information and résumé for employment purposes, this information will only be used to evaluate your qualifications for the desired position and, if needed, to contact you.

Cookies are small data files that a website stores on your computer’s hard drive or in random access memory when you are viewing the website. They keep a record of your preferences, making your subsequent visits to the Site more efficient. In certain cases, this information is only kept during the session and is deleted when you close your browser. In other cases, the information is stored on your hard drive and, upon your next visit to the Site, the cookies are used to recall such information.

Cookies may store a variety of information, including a unique user ID that can be used to track the pages of the Site you have visited and the number of times that you view a particular page or other item on the Site, login or registration information, your preferences, and your purchase history, where available. No personal information is transmitted via cookies. Cookies, by themselves, cannot be used to reveal or discover the identity of the individual user; your acceptance of our cookies will not compromise your anonymity while using the Site.

We use cookies to improve the online experience of users of the Site. Statistical information is not linked to any personal information and cannot identify any individual user of the Site.

“Web beacons,” also sometimes called “pixel tags,” are small strings of code placed on a web page or in an email message for the purpose of transferring data. We, and the online marketing company or companies that we use to help manage our Internet business and communications, employ cookies and web beacons placed on the Site’s pages to deliver our ads, to measure the effectiveness of our advertising—including our email promotions—and to learn how visitors use the Site. The ad-serving technology uses non-personal information about your visits to the Site and the sites on which we advertise to serve our ads to you. In the course of delivering our advertisements, a unique third-party cookie may be placed or recognized on your browser. “Phishing” is a scam designed to steal your personal information. If you receive an email that appears to be from us requesting your personal information, do not respond. We will never request your personal information via email.

We would like your consent to collect, use, and share your personal information for the purposes and in the manner described herein, including in order to contact you and provide you with promotional communications. Nonetheless, we want you to know that you have choices and may refuse or withdraw your consent as follows.

You may choose not to submit any personal information to us; however, this may limit our ability to serve you, as it may prevent you from purchasing items from the Site or participating in our contests. You may also choose to submit only the information required to complete purchases or contest entries. In addition, you may choose to limit how we use your personal information by emailing us at the contact link below.

If you have already consented to the collection, use, and/or disclosure of your personal information, you may subsequently “opt out” at any time, subject to legal or contractual restrictions and reasonable notice, by contacting our Privacy Officer as described in the section entitled “Contacting Us” below, or by following the “opt-out” instructions provided in the promotional materials sent to you. Our Privacy Officer will also be able to provide you with more information regarding the implications of withdrawing your consent.

For requests not to receive promotional communications from us and/or other Company Affiliates, please be sure to include your full name, address, telephone number, and any email address you used when you signed up, entered a contest on the Site, registered, or made a purchase from us. It may take up to ten (10) days to process your request, during which time you may continue to receive communications from the Company or Company Affiliates.

If you prefer not to receive promotional information from the Company, please follow the unsubscribe instructions set out in this Policy or in the respective privacy policies and/or communications of the Company Affiliates.

With regard to SMS messages, to stop receiving SMS messages at any time, text STOP to short code 268257. You will stop receiving SMS messages from us once you confirm your phone number’s removal from our database. Alternatively, you may send your request to unsubscribe by email by contacting our Privacy Officer, as described in the section entitled “Contacting Us.”

We will keep your personal information only as long as is reasonably necessary for the purposes described in the Policy.

We take great care in maintaining the security of the personal information we collect. We have adopted physical and technological processes and procedures to protect the confidentiality of personal information and to safeguard it against loss or theft, as well as unauthorized access, disclosure, copying, use, or modification, taking into account, among other things, the sensitivity of the information and the purposes for which it is to be used.

Furthermore, each and every one of the Company's employees, mandataries, or agents must abide by the Policy.

The Company also strives to offer its customers a secure shopping environment. The Site is secured through SSL encryption technology, using certificates provided by GeoTrust, one of the world's largest digital certificate providers. This means that all credit card information and other confidential information provided by the customer is encrypted. All encrypted credit card data is stored on servers that are certified PCI Level 1 compliant. This helps protect our customers' information against identity theft, viruses, spyware, and other online threats.

While we strive to protect your personal information, we cannot ensure or warrant the security of any information you transmit to us, and you do so at your own risk.

Depending on the province in which you live, you have various rights with respect to the Company’s collection, use, and disclosure of your personal information. These may include:

Access: You have the right to request whether we hold personal information about you and to request a copy of such information. There are exceptions to this right, so access may be denied if, for example, making the information available to you would reveal personal information about another person, or if we are legally prevented from disclosing such information.

Accuracy: We aim to keep your personal information accurate, current, and complete. We encourage you to contact us to let us know if any personal information is inaccurate or has changed, so that we can update it accordingly.

Once we have received notification that you have withdrawn your consent, we will no longer collect, use, or disclose your personal information for the purposes to which you originally consented, unless there is another legal ground for doing so.

Complaints: Although we encourage you to speak with us first, if you believe that your personal information protection rights may have been violated, you have the right to lodge a complaint with the applicable supervisory authority or to seek a remedy through the courts.

Rights for Quebec Residents: If you reside in the province of Quebec, in certain circumstances you may also have:
1. The right to request that we cease disseminating your personal information;
2. The right to request that we de-index any hyperlink attached to your name that provides access to information by technological means;
3. The right to request that we re-index a link providing access to information; or
4. The right to request that we communicate to you, as well as to any person or body authorized by law to collect such information, any computerized personal data collected from you in a commonly used technological format.

You may exercise any of the above rights by contacting us using the details provided in the “Contacting Us” section below. We generally respond to all access requests within 30 days of receiving all necessary information. In circumstances where we are not able to provide access, or if additional time is required to fulfill a request, we will advise you in writing.

We may not release certain types of information based on exemptions specified in applicable laws. Where possible, we will sever the information that will not be disclosed and provide you with access to the remaining information. Should we be unable to provide access to or disclose personal data to you, we will provide you with an explanation, subject to any applicable restrictions.

In certain circumstances—such as where the request is excessive or unfounded—we may charge you an administrative fee for access to your personal data. We may also charge for additional copies. You will be informed of any applicable fees before we proceed with the request.

In no event shall the Company or any Company Affiliates be liable to you or anyone else for any damages or injury whatsoever (including, but not limited to, direct, indirect, incidental, special, consequential, exemplary, or punitive damages) arising out of or in connection with the misuse of personal information by those websites.

The Company has installed on the Site various social media plug-in protocols, such as buttons linking to the Company’s Facebook, Instagram, Pinterest, Twitter, and YouTube pages, which allow you to share your likes and interests in the Company’s products, services, and promotions with your friends, followers, and contacts. When you click on a social media plug-in protocol link, a link to the Site may appear in the "Likes and Interests" section of your Facebook or other social media profile. Your friends and contacts will be able to see the link and be directed back to the Site if they share your likes and interests, or if they are interested in learning more about our products, services, and promotions.
